Personal accountability is a major focus for regulators and other authorities in many jurisdictions when corporate criminal misconduct takes place. Directors are increasingly at risk of being held liable for the criminal acts of the company that occur on their watch even if they are not directly involved in the wrongdoing. This survey examines the standards for directors’ criminal liability for corporate offences, the relevant reporting requirements, and potential insurance coverage in five key jurisdictions in the Asia Pacific region.
