Insolvency Bitesize - November 2024

Welcome to the Autumn edition of our Insolvency Bitesize series. 

In this edition, we provide a one page round-up of the legal and practical developments in the insolvency industry. 

These include highlighting:

  • recent case law on the meaning of secured and unsecured creditors;
  • pre-pack practice under the new UK Listing Rules; and
  • creditor decision making processes and the rights of sanctioned creditors.

The Government announced in the Autumn budget that it intends to focus on rogue company directors by increasing the collaboration between HMRC, Companies House, and the Insolvency Service. Its aim is to tackle “those using contrived corporate insolvencies and dissolutions, often referred to as ‘phoenixism’, to evade tax.” This may be something we return to in the next edition when further detail becomes available.
