The Linklaters International Arbitration Practice held a webinar on “The Protection of Foreign Investments in the Energy Sector” on Tuesday 24 January.
Gerard Meijer (Partner, Amsterdam), Raquel Galvão Silva (Counsel, Lisbon), Guillaume Croisant (Managing Associate, Brussels) and Hannes Ingwersen (Associate, Frankfurt) provided an overview of the protections offered by the Energy Charter Treaty and the latest developments in relation thereto, including the ongoing modernisation process and the recent announcements by several European Union Member States of their intent to withdraw from the treaty.
Such withdrawal would inevitably have consequences for energy companies from and investing in the concerned jurisdictions. The speakers explained the protections that remain available to these investors under other instruments, notably investment treaties, the European Convention on Human Rights, EU law and domestic legislation. Certain provisions contained in contracts between states and investors may also be relevant.
