Supplemental Arrangement Concerning Mutual Enforcement of Arbitral Awards between the Mainland and the Hong Kong SAR
On 27 November 2020, the Supplemental Arrangement Concerning Mutual Enforcement of Arbitral Awards between the Mainland and the Hong Kong Special Administrative Region (the “Supplemental Arrangement”) was signed between the Secretary for Justice of Hong Kong and the Vice President of the Mainland Supreme People’s Court.
The Supplemental Arrangement brings two major improvements to the preceding Arrangement Concerning Mutual Enforcement of Arbitral Awards between the Mainland and the Hong Kong Special Administrative Region, by: (i) allowing enforcement proceedings to be brought in both jurisdictions concurrently; and (ii) empowering the enforcing court to grant post-award interim relief in support of the enforcement application.
