Overview

Marc works in the Amsterdam banking practice group where he advises on cross-border finance transactions, ranging from leveraged finance to trade and export finance. His specialty is finance restructuring and insolvency related matters. His experience includes trade and export financings, acquisition financings and project financings. He has gained particular experience in lending transactions in the energy sector.

Marc also has over three years’ experience in Linklaters’ dispute resolution practice group, where he represented financial institutions in banking disputes and has completed a post-graduate course in insolvency law (cum laude).

Work Highlights

  • Crédit Agricole Corporate and Investment Bank SA: advising on the successful cross-border restructuring of McDermott International and Lealand Finance Company as implemented by means of a Dutch WHOA and concurrently an English Restructuring Plan, involving the amendment and extension of $2.6 billion in letter of credit and term loan facilities, and the discharge and release of approximately $2 billion in unsecured litigation claims.
  • Steinhoff International Holdings N.V. (now liquidated): advising on its corporate restructuring, delisting and €10 billion debt and equity restructuring, resulting in its liquidation in fall 2023 and the transfer of assets and liabilities to a new holding company held by five independent Dutch trust foundations.
  • Steinhoff International Holdings N.V. (now liquidated): advising on its € 14 billion debt restructuring through a Dutch law suspension of payments proceedings in parallel with South African scheme of arrangement.
  • Western European oil trader Finco Fuel: advising on its ESG-linked borrowing base facilities with a four bank syndicate.
  • The CoCom of secured creditors: advising on the restructuring of Van Gansewinkel's syndicated debt facilities.
  • The lenders: advising on new financing for the distressed Dutch department store Vroom & Dreesmann.
  • A major bank: representing in a NAI arbitration arising out of a complex corporate demerger.
  • Pronovias: advising BC Partners on the execution of a Framework Implementation Agreement in connection with the restructuring of the Spanish headquartered group, Pronovias.
  • Haya Real Estate: advising on its successful recapitalisation (including in relation to the recourse position vis-à-vis a Dutch incorporated parent entity) utilising an English scheme of arrangement and Spanish homologación.

Professional experience

Marc started his career as an associate at Linklaters in 2014 and was promoted to Managing Associate in 2020. During this time, he spent several months working at Linklaters’ Paris office. Marc regularly publishes case notes and legal articles on insolvency and restructuring law.

Education and qualifications

Marc gained a master’s degree in Law at Leiden University and a postgraduate qualification in insolvency law (cum laude) at the Grotius Institute of the University of Nijmegen. 

Prior to this, Marc obtained a bachelor’s degree at Tilburg University and studied at the Radzyner Law School at the Reichman University in Herzliya, Israel.

Marc Noldus is a member of INSOLAD, an association for insolvency lawyers and he is also a member of the Dutch Restructuring Association.
