The New Anti- Monopoly Judicial Interpretation and Key Takeaways for Business Compliance
On 24 June 2024, the Supreme People’s Court (the “SPC”) published the amended Judicial Interpretation on Several Issues Concerning the Application of Law in the Trial of Monopoly Civil Dispute Cases (the “New Judicial Interpretation”). The New Judicial Interpretation has come into force on 1 July 2024 and replaced the previous judicial interpretation issued in 2012. The New Judicial Interpretation was made against the backdrop of the amendments to the Anti-Monopoly Law in 2022 (the “AML”). With a draft being released for public comments on 18 November 2022, the New Judicial Interpretation was adopted 14 months thereafter by the Adjudication Committee of the SPC on 4 February this year and made public recently.
