Diana Jeschke

Diana Jeschke is senior counsel in the Energy & Infrastructure Group. She focuses primarily on regulatory matters affecting clients in the electricity industry before the Federal Energy Regulatory Commission (FERC).

Diana has advised and represented clients in matters concerning wholesale electric market rules, generator interconnections, enforcement investigations regarding alleged market manipulation, qualifying facilities, market-based rates, transfers of FERC-jurisdictional assets and other issues involving the Federal Power Act and the Public Utility Regulatory Policies Act of 1978 (PURPA).

Diana routinely advises clients in relation to ISO/RTO market rules and generator interconnection matters arising in CAISO, PJM, MISO, NYISO, SPP and other territories, and has represented clients in numerous related FERC proceedings. She has counseled clients operating in these territories in connection with interconnection procedures and related agreements, and other matters including ancillary services and wholesale market participation. She also advises clients as to FERC enforcement matters and represented an electric generator in a FERC enforcement proceeding in connection with its wholesale electric market participation.

She also advises on project development, reviewing and negotiating related commercial agreements, including power purchase and other offtake agreements. 

Before joining Linklaters, Diana was at another law firm where she practiced in the firm's Energy Group, and prior to that she was an attorney-advisor at FERC.

• Elia Group SA/NV: advising on its acquisition, through Elia Group’s wholly-owned subsidiary WindGrid USA LLC, of a 35.1% stake in energyRe Giga Projects, a subsidiary of energyRe LLC, the proceeds of which will be used to fund renewable U.S. transmission and energy generation projects.

• Multiple generation developers: advised on generator interconnection matters arising in CAISO, PJM, MISO, NYISO, SPP, ISO-NE and other territories, represented in interconnection agreement negotiations and related FERC proceedings.

• Generation developers: represented in reviewing and negotiating offtake agreements. 

• Generation developer: represented in CAISO in FERC generator interconnection complaint proceeding.

• Fleet owner: advised in connection with California Air Resources Board advanced clean fleets rulemaking.
• Multiple generation developers: successfully represented in obtaining FERC waivers of certain ISO/RTO generator interconnection requirements.
• New England generator: represented in FERC enforcement proceeding involving allegations of market manipulation.
• Multiple generator clients: represented in FERC rate proceedings to obtain reactive power compensation.
