Ordinance limits temporarily the indexation of rents

The Parliament of the Brussels Capital Region adopted on 9 December 2022 an ordinance limiting the indexation of commercial leases in the Brussels Region (Ordonnance du 15 décembre 2022, organisant la limitation de l’indexation des baux commerciaux/Ordonnantie van 15 December 2022, tot regeling van de beperking van de indexering van de handelshuurprijzen), which was published on 21 December 2022 in the Belgian State Gazette.

This ordinance introduces a mechanism of temporary limitation of the indexation of commercial leases in an attempt to curb the daunting inflation rise and to mitigate its consequences on the economic situation of businesses.
