Artificial Intelligence

Artificial intelligence (AI) has the potential to change our lives, our planets and the face of industry irrevocably. But that potential also brings with it unknown risks. This means that AI is now one of the top agenda items for businesses and Boards. How can they make sure they take swift advantage of the opportunities and mitigate risks? And how do they ensure that they embed responsible AI practices within their organisations in the long term?

Our global technology team is one of the longest-standing and most sophisticated in the world. We offer individual lawyers with deep specialism in both the regulatory and commercial issues affecting AI, meaning that advice is holistic and capable of real-world implementation. Our knowledge of key regulators and vendors in this space means that our clients benefit from deep market insight.

Our tech team is part of a much broader multi-disciplinary global AI practice that advises on the broad range of regulatory, enforcement and litigation risks associated with the use of AI. Our data, IP, competition and consumer, product liability, tort/contract, employment, ESG and sectoral law specialists work together seamlessly to offer pragmatic and cutting-edge advice.

Responsible AI - Compliance

Our tech practice has over 30 years’ expertise in building practical global compliance project plans and programmes, as well as conducting readiness and other assessments. We are helping clients to build responsible AI programmes based on the EU AI Act, emerging approaches in Asia and the US, and more. The evolving nature of AI regulations means that these programmes need to be designed to cater for regulatory change, and also ideally to fit with existing compliance programmes (whether for data, IPESG, etc.) and future obligations under the broader EU Digital Package and analogous global legislation. Our AI compliance offering can be enhanced with the use of alternative legal services, including project managers, consultants and more.

AI Projects

Traditional approaches to technology contracts will not be appropriate for AI in many key ways. Pre-contractual diligence and, where appropriate, risk assessments will be important in identifying and mitigating risks that cannot be treated contractually. Our team can support clients in clarifying their use case for AI, what outcomes/benefits are sought, how the relevant AI has been trained and works, and what the associated limitations and risks are. This then allows us to ensure that any contractual arrangements put in place include appropriate safeguards and that key risk areas are appropriately flagged, treated and/or risk accepted by the project team.

Contentious AI

Our multi-disciplinary investigations team assists clients in identifying and addressing the regulatory, enforcement and litigation risks associated with the use of AI. These are wide-ranging and span areas from data, IP, competition, competition litigation, product liability, tort/contract, employment, ESG and sectoral laws (e.g. financial services, healthcare) and more. As a global, full-service firm, we are privileged to be able to deliver top-tier multi-disciplinary teams that are capable of providing holistic, consistent, global advice across all of these relevant specialist areas.
