Wi-Fi Terms of Use

By using this service you agree to comply with the terms and conditions of this agreement (the Terms), as may be amended by Linklaters from time to time in its sole discretion.  If at any time you do not agree to any of these Terms, or find them unacceptable, you must immediately cease all use of this service.

1. Use and availability of the service

1.1. You agree that whilst using this service, you will comply with all applicable laws, rules and regulations and not use this service for any purpose that is fraudulent, unlawful, defamatory, obscene, offensive, abusive, malicious or harmful in nature or in any way which is considered discriminatory or harassment.

1.2. You agree that you will use the access provided responsibly and with full regards to the safety, security, and privacy of all other users, devices and resources.

1.3. You agree that Linklaters will not assume any responsibility if information you transmit across the using the service is accessed, altered or corrupted. You also accept that Linklaters is not responsible for any unauthorised access to your computer, or the introduction of any virus or other harmful code, that may result from use of this service.

1.4. You are responsible for obtaining, maintaining and setting up your own equipment and hardware in order to access and use the service and you take responsibility for the protection of your equipment through the use of up to date virus protection, personal firewalls and any other suitable measures you deem necessary.

1.5. You accept that Linklaters may be required to take the service down for periodic maintenance or unforeseen downtime and may do so without notice at any time at its discretion.

2. Termination

2.1. Linklaters may suspend, withdraw or discontinue the provision of this service without notice at any time at its discretion.

3. Indemnity

3.1. You agree to indemnify Linklaters and its partners, directors and employees against any and all losses suffered by Linklaters, as a result of your use of this service in breach of these Terms.

4. Warranties

4.1. Linklaters is providing this service to you "as is" without warranty of any kind. You assume the risk of any and all damage or loss from use of, or inability to use the service.

4.2. To the maximum extent permitted by law, Linklaters expressly disclaims any and all warranties, express or implied, regarding the service and Linklaters performance of this agreement, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non infringement. Linklaters does not warrant that the service will meet your requirements or that the operation of the service will be uninterrupted or error free.

5. Liability

5.1. To the maximum extent permitted by law, in no event will Linklaters be liable for damages of any kind (including but not limited to, special, incidental or consequential damages, lost profits or lost data, regardless of the foreseeability of those damages) arising out of or in connection with the use or performance of the service or any other material or services provided to you by Linklaters.

5.2. The limitation will apply regardless of whether the damages arise out of breach of contract, tort, or any other legal form of action. Without limiting the foregoing, in no event will Linklaters aggregate liability to you relating to or arising out of this agreement, whether in contract, tort or otherwise, exceed the total amount, if any, paid by you to Linklaters for your use of the service as set out herein.

6. Governing law

6.1. These Terms and all matters arising from or in connection with them shall be governed by and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
