Welcome to our Autumn Edition of Trustee Agenda.
With a new government taking the reins, trustees will be keen to understand whether this is likely to herald a change in the direction of pensions policy in the UK. We take a look at what we know so far in our first article.
We also provide an update on a topic which frequently gives rise to questions in practice: the meaning of restrictions on amendment powers. The Court of Appeal has recently handed down an important decision in the BBC case, which considered the meaning of “interests” in an amendment power restriction. This follows a long line of cases on restrictions in amendment powers, which demonstrate the importance of considering the particular language used in the relevant scheme rules.
Finally, it is with the greatest sadness that we mark the passing of our respected and very much loved colleague and friend, Tim Cox.
