2018 HKIAC Rules now in force
The Hong Kong International Arbitration Centre 2018 Administered Arbitration Rules (the "2018 HKIAC Rules") came into force on 1 November 2018. They will apply in respect of arbitrations where a notice was submitted on or after that date.
As we have previously reported, the 2018 HKIAC Rules include amendments relevant to the use of technology (Article 13.1), an early determination procedure (Article 43) and provisions requiring parties to disclose any third-party funding arrangements (Article 44).
The 2018 HKIAC Rules are the result of a comprehensive revision process which began in August 2017 and was overseen by the HKIAC Rules Revision Committee. The process included extensive public consultation with users, stakeholders and interest groups.
