LMA activity in this period includes the publication of a new intercreditor agreement for unitranche transactions and a new facility agreement for export finance buyer credit transactions supported by an export credit agency. EU legislative proposals currently under discussion aim to address banks’ portfolios of non-performing loans and, separately, propose a new approach to the law applicable to the third-party effects of assignments of claims. We consider their relevance for the loan markets.
